MSHA’s Final Rule for Respirable Crystalline Silica: What MNM Operators Need To Know

In 2024, the U.S. Mine Safety and Health Administration (MSHA) issued its final rule, Lowering Miners’ Exposure to Respirable Crystalline Silica and Improving Respiratory Protection. The aim of The MSHA crystalline silica rule is to reduce miners’ exposure to silica, a carcinogen known to cause numerous health complications. 

Because silica is the most abundant mineral in the earth’s crust, it poses an acute risk to the respiratory health of miners. Long-term exposure to silica can lead to a wide range of diseases and infections like lung cancer, pulmonary fibrosis, Chronic Obstructive Pulmonary Disease (COPD), and tuberculosis.

What Is the MSHA Final Rule for Respirable Crystalline Silica?

The MSHA silica final rule sets the following regulations for MNM (metal and nonmental) mine operators:

  • Lowers the permissible exposure limit (PEL) for respirable crystalline silica to 50 micrograms per cubic meter of air (µg/m3) for a full shift, calculated as an 8-hour time-weighted average (TWA) for all miners. 
  • Establishes an action level for respirable crystalline silica at 25 µg/m3 for a full shift, calculated as an 8-hour TWA for all miners.
  • Includes uniform requirements for controlling and monitoring exposures to respirable crystalline silica at coal and MNM mines.
  • Includes medical surveillance requirements for MNM mines, modeled on the existing medical surveillance requirements for coal mines.
  • Updates existing respiratory protection requirements by incorporating by reference a voluntary consensus standard by the American Society of Testing and Materials (ASTM) that reflects the latest advances in respiratory protection technologies and practices – ASTM F3387-19 Standard Practice for Respiratory Protection.

The deadline to reach these objectives is April 8, 2026
